Supreme Court nominee steers clear of Trump criticism

During his confirmation hearing, Kavanaugh was seen as evasive on the question of whether he would support a reversal of Roe v Wade, the 1973 ruling protecting abortion rights.

The 53-year-old appellate judge stuck to a well-rehearsed script throughout his testimony, providing only glimpses of his judicial stances while avoiding any serious mistakes that might jeopardize his confirmation.

During the hearings on his nomination to the D.C. Circuit a few months after the Miranda news broke, Kavanaugh actively hid his own involvement, lying to the Senate Judiciary Committee by stating unequivocally that he not only knew nothing of the episode, but also never even received any stolen material.

Democrats pressed Kavanaugh over several days on the issue of presidential power.

In the coming weeks, as the final vote for Kavanaugh's confirmation draws near, the handful of Democrats on the fence who are in a potential political bind depending on how they vote will begin to maker their positions known. Their hope is that two Republican senators who support abortion rights could break from their party and vote against him.

But according to former White House counsel Bob Bauer and Professor Ryan Goodman in a Just Security blogpost, Kavanaugh has written that the constitution "seems to dictate" that Congress not federal prosecutors can investigate a sitting president, and that the constitution "appears to preclude" prosecution of the president when in office. The document had been held by the committee as confidential but was made public Thursday. Senate Majority Leader Mitch McConnell said he hopes to have Trump's nominee confirmed to replace retired Justice Anthony Kennedy before the new court session begins October 1.

On Friday, Democratic witnesses expressed concern about Kavanaugh's record on a range of issues including affirmative action, the rights of people with disabilities, access to birth control and abortion. Throughout his testimony, Kavanaugh repeatedly stated the importance of judicial independence.
